Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Pose Daddy Telegram bot (“Bot”, “Service”, “we”, “us”, or “our”), operated by Pose Daddy s.p. (the “Owner”). By accessing, using, or interacting with the Bot, you (“User”, “you”) agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Age Restriction
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that your use complies with all applicable laws. The Service is strictly for adults and contains or bridges generation that allow any kind of content. Minors are prohibited from any use.

2. Nature of the Service
The Bot is a private Telegram-based tool that allows Users to generate AI images and short videos using APIs (primarily Leonardo AI and WaveSpeed AI). Features include pose matching from reference images, image-to-image editing (“Make Changes”), different modes, and motion animation from short video clips.
All generations are intended solely for fictional content using User-provided and owned reference images.

The Service does not support, allow, or facilitate:

  • Upload or use of images/videos of real persons (living or deceased).
  • Non-consensual intimate imagery, deepfakes, or any content depicting real individuals in sexualized/nude contexts.
  • Child exploitation, child sexual abuse material (CSAM), or any depiction (real, AI-generated, cartoon, anime, etc.) of minors in any contexts — zero tolerance.
  • Illegal, violent, hateful, harassing, defamatory, or non-consensual content.

3. Prohibited Uses & Acceptable Use Policy
You agree not to use the Service to:

  • Generate, upload, share, or request content involving real or identifiable people and individuals without explicit, verifiable consent.
  • Create, distribute, or threaten non-consensual intimate visual depictions (including AI-generated “digital forgeries” under laws such as the U.S. TAKE IT DOWN Act or equivalent statutes).
  • Involve minors in any possible way (automatic permanent ban and potential reporting to authorities).
  • Violate Leonardo AI, WaveSpeed AI, Telegram, or any third-party terms.
  • Engage in spam, harassment, commercial misuse without permission, or any illegal activity.

Violation of this section may result in immediate account termination, loss of access, and — where required or appropriate — reporting to law enforcement or platform providers.

4. Third-Party Services & No Liability for Providers
The Service relies on Leonardo AI and WaveSpeed AI APIs. You are solely responsible for obtaining and maintaining valid API keys and complying with their terms of service. We bear no responsibility for:

  • Availability, quality, accuracy, or moderation of third-party generations.
  • Credits, billing, refunds, or suspensions by Leonardo AI or WaveSpeed AI.
  • Any filtering, blocking, or changes to their models/prompt handling.
  • Privacy practices of third parties.

Use of the Service is at your own risk. We disclaim all liability for outputs, including unexpected, offensive, or legally problematic results.

5. User Content & Inputs
You must have and retain ownership of any inputs (e.g., reference images) you provide. By submitting inputs, you grant us a limited license to process them solely to provide the Service. You warrant that all inputs are SFW, fictional, and do not infringe third-party rights or depict real persons without consent.

You own the generated outputs (“Outputs”), subject to third-party API terms (e.g., Leonardo may retain rights on free tiers). Outputs are provided “as is” with no warranty on quality, consistency, or legality.

6. Indemnification
You agree to indemnify, defend, and hold harmless the Owner, its affiliates, officers, directors, agents, and licensors from any claims, damages, losses, liabilities, costs (including reasonable attorneys’ fees) arising from:

  • Your use of the Service.
  • Your breach of these Terms.
  • Your violation of any law, third-party rights, or third-party service terms.
  • Any content you generate, share, or use (including claims of non-consensual deepfakes, privacy invasion, or defamation).

7. Limitation of Liability
To the maximum extent permitted by law, the Owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including lost profits, data, or goodwill) arising from your use of the Service, even if advised of the possibility.

Our total aggregate liability shall not exceed the amount you paid us in the preceding 12 months (or $100, whichever is greater). This limitation applies regardless of legal theory.

8. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted access, error-free operation, or that Outputs will meet your needs or be legal/safe.

9. Termination & Suspension
We may suspend or terminate your access at any time, without notice or refund, for any reason, including suspected violation of these Terms, abuse, or legal risk. You may stop using the Service at any time.

10. Subscriptions

10. 1. Subscription Plans
The Service is available via a paid subscription (“Subscription“) at the price and billing frequency displayed during signup or in the Bot (currently $30 USD per month, subject to change with notice). Prices exclude applicable taxes or fees. By subscribing, you authorize platform Mymembers.io recurring charges to your selected payment method until cancelled.

10. 2. Billing and Renewal

  • Subscriptions renew automatically at the end of each billing period (monthly) unless cancelled.
  • You will be charged on the same date each month (or next business day if unavailable).
  • We may change pricing or terms with at least 30 days’ notice via Bot message or pinned announcement. Continued use after changes constitutes acceptance.

10. 3. Cancellation
You may cancel your Subscription at any time. To cancel:

  • All payments are non-refundable and non-cancellable except as required by law.
  • In the EU/UK: You have a 14-day right of withdrawal from the date of subscription. To exercise, contact us within 14 days stating your intent to withdraw. If you consented to immediate service start, you waive this right for services already performed (we will confirm this consent during signup).
  • In the US: Follow FTC Click-to-Cancel rules — cancellation is available via the same interface/method used for signup.
  • We process refunds (where required) within 14 days to the original payment method.

10. 5. Failed Payments & Suspension
If payment fails, we may retry or suspend access until resolved. Continued failure may lead to termination without refund.

10. 6. Effect of Termination
Upon cancellation or termination:

  • Access ends at the billing period close.
  • We delete or anonymize your data per our Privacy Policy (subject to legal retention).
  • No refunds for partial periods unless legally mandated.

10. 7. Channel Membership Requirement
To access and continue using certain features of the Service, you must remain subscribed to our official members-only Telegram channel (@PoseDaddy_Members or any successor channel we designate).

Joining and staying in this channel is a condition of your access to the Bot. If you leave or are removed from the channel, your access to the Service may be restricted or suspended until you re-join.

We may use the channel to deliver important updates, feature announcements, exclusive content, support information, or other benefits related to your Subscription. Membership in the channel is paid and it comes with the benefit of using the bot.

You will be provided with a direct join link during onboarding or when required. We recommend enabling notifications in the channel to stay informed.

11. Changes to Terms
We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify via Bot message or pinned announcement where practical.

12. Governing Law & Dispute Resolution
These Terms are governed by the laws of Slovenia, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts of Ljubljana.

13. Severability
If any provision is held invalid, the remainder remains in effect.

14. Entire Agreement
These Terms constitute the entire agreement between you and us regarding the Service.

By using Pose Daddy, you confirm you are 18+, agree to these Terms, and understand the Service is for fictional content only. Misuse may result in permanent ban and potential legal consequences.
